This document sets out the terms governing the use of this website and the purchase of products on this site (hereinafter referred to as the "Terms").

Please read the Terms carefully before using this website. By using this site or placing an order through this site, you agree to be bound by these Terms; therefore, if you do not agree with all the Terms, you must stop using this site.

These Terms may be modified. It is your responsibility to read them regularly, as the terms in force at the time of use of the site or execution of the Agreement (as defined below) will be applicable to you.

  1. USE OF OUR WEBSITE

By using this website and placing orders through it, you agree to:

  1. Use this website only to make legitimate inquiries or place legally valid orders.
  2. Not place any false or fraudulent orders. If we can reasonably determine that an order is false or fraudulent, we shall be entitled to cancel the order and inform the relevant authorities.
  3. Provide us with your true email address, postal address, and/or other contact information. You also agree that we may use this information to contact you.

If you do not provide us with all the necessary information, we will not be able to process your order.

By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into agreements.

 

  1. THE ORDER

To place an order, the Customer may be required to fill out an identification form provided for this purpose, indicating the requested information (mandatory information: title, last name, first name or business name, address, email, password, phone number for delivery).

The customer will receive a confirmation email of their registration.

When creating an account, the Customer must ensure that the information provided is accurate and complete. It is the responsibility of the customer to keep this information up to date. In case of an error, particularly in the recipient's contact details, SAS Victoria Valette cannot be held responsible for the inability to deliver the Products.

 

  1. ESSENTIAL PRODUCT FEATURES

The characteristics of the various products offered for sale are presented in each description, within the "Shop" section of our website. Each product is presented with a description outlining its main technical features. The photographs are as accurate as possible but do not constitute a contractual document and do not engage SAS Victoria Valette in any way.

 

  1. EXECUTION OF THE CONTRACT

The information contained in these Terms and the details contained on this website do not constitute a sale offer, but an invitation to tender. No agreement will exist between you and us regarding any product until we have accepted your order. If your offer is not accepted and a payment has already been debited from your account, it will be fully refunded. To place an order, you must follow the online purchase procedure and click on "Authorize Payment." Shortly after, you will receive an email acknowledging receipt of your order (the "order confirmation"). Please note that this does not mean your order has been accepted, as it constitutes an offer by you to us to buy one or more products. All orders are subject to our acceptance, which will be confirmed by an email confirming the acceptance of the order.

 

  1. REFUSAL TO PROCESS AN ORDER

Some products are individually and handmade. For others, a quantity is applied for quality manufacturing with manufacturers chosen by SAS Victoria Valette.
We reserve the right to remove any product from this website at any time and to remove or edit any material or content on this site.

Although we always strive to process all orders, there may be circumstances that require us to refuse to process an order after sending you an order confirmation, which we reserve the right to do at any time, at our discretion.

Here are some examples (non-exhaustive list provided for information) where we might not accept your order: we are unable to obtain payment authorization; shipping restrictions apply to a particular item; the item ordered is out of stock; the item ordered does not meet our quality control standards and is withdrawn; or you do not meet the eligibility criteria set out in these terms.

We will not be liable to you or any third party for removing any product from this website, removing or editing any material or content on this site, or for not processing an order once we have sent you an order confirmation.

 

  1. DELIVERY

Subject to the provisions of clause 5 above regarding product availability and except in exceptional circumstances, we will strive to fulfill your order for the products specified in the order confirmation within the time frame indicated in the order confirmation.

However, delays may occur due to reasons such as product customization, unforeseen events, or the delivery area.

If, for any reason, we cannot meet the delivery date, we will inform you and give you the option to continue the purchase with a new delivery date or to cancel the order with a full refund. Please note, however, that we do not deliver on Sundays.

For the purposes of these Terms, "delivery" shall be deemed to have taken place or the order "delivered" at the time of the signature of the receipt of the products at the agreed delivery address.

Please note that items will be shipped within 5 (five) days of your order (except for pre-ordered items mentioned in the corresponding paragraph below, article 8).
Items will be shipped to the delivery address provided by the customer when placing the order.

The order will be sent to the delivery address indicated by the customer in the registration form—it is important that the customer ensures that the address details are correct as they cannot be changed; SAS Victoria Valette cannot be held responsible for lost orders due to incorrect or incomplete address information entered on an order.

 

  1. TRANSFER OF RISK AND OWNERSHIP

The products will be under your responsibility from the moment you or a third party designated by you, other than the carrier, physically takes possession of the products. You will become the owner of the products once they have been delivered and we have received full payment of the amounts due, including delivery charges.

 

  1. PRE-ORDERED ITEMS

As part of our ecological approach, some products are handmade to order and according to the customer's specifications, as indicated on the product sheet.

As a result, a period of 4 to 6 weeks (excluding the month of August) is generally observed between the order date and the date of receipt of the product by the customer, depending on the pre-ordered product. This information is explicitly made available to the customer during the payment process.

Similarly, despite our best efforts and controls, minor and non-substantial variations may exist between the photos presented on the site and the delivered items.

By placing an order on the Site, the Customer acknowledges and accepts both this delivery time and these minor and non-substantial variations from one item to another. Nevertheless, if the delivered item does not suit you, you benefit from the legal guarantee of conformity.

Exceeding this period cannot give rise to any cancellation of the order, any reduction in the price paid by the buyer, or any payment of damages, it being specified that in some special cases, the above-mentioned deadlines may be longer.

However, in accordance with the provisions of article L.121-20-3 of the Consumer Code, if delivery does not occur within 100 days from the day after the date on which the Customer placed their order, the Customer will have the option to cancel their order without charge. The sums paid will then be refunded to them.

These purchases are excluded from the right of withdrawal by law (article L221-28 of the Consumer Code, i.e., products customized at the customer's request).

 

  1. PRICING AND PAYMENT

The price of the products will be the one indicated on our website, except in case of manifest error. Although we strive to ensure that all prices on the website are accurate, errors may occur. If we discover a manifest error in the price of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be considered canceled, and you will be fully refunded.

We are not obliged to provide you with the products at an incorrect lower price (even after we have sent you an order confirmation) if the pricing error is manifest and unmistakable and could reasonably have been recognized by you as a pricing error.

The prices displayed on our website include VAT but exclude delivery costs and any customs duties and taxes, which will be added to the total amount due.

The applicable delivery charges will be clearly indicated at the time of purchase.

Payment can be made by the means indicated on our website.

 

  1. RETURN POLICY

The return policy is more fully described in the separate document "Shipping and Returns."

 

  1. LEGAL WARRANTIES

 All products provided by SAS Victoria Valette benefit from the legal warranty provided by Articles 1641 and following of the French Civil Code. In case of non-conformity of a product sold, it may be returned to SAS Victoria Valette, which will take it back, exchange it, or refund it. All claims, exchange, or refund requests must be made by email to the following address: info@victoriavalette.com within thirty days after delivery, counting from the delivery of the product (for the legal warranty of conformity) or from the discovery of the defect (for the legal warranty against hidden defects).

 

  1. WEAR AND TEAR OF CLOTHING

In case of wear and tear of clothing over time, we suggest you contact us at the following email address: info@victoriavalette.com. We will then make our best efforts to offer you a creative repair solution at no cost. You are free to accept or decline the offer.

 

  1. LIABILITY

The items offered comply with current French legislation. SAS Victoria Valette cannot be held liable in case of non-compliance with the legislation of the country where the item is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the items you plan to order.

In the process of distance selling, SAS Victoria Valette is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other involuntary problems.

 

  1. INTELLECTUAL PROPERTY

All elements of the website www.victoriavalette.com are and remain the exclusive intellectual property of SAS Victoria Valette. All texts and images presented on the Victoria Valette site are reserved worldwide and without time limitation under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited. Therefore, no one is authorized to reproduce, exploit, or use, for any reason whatsoever, even partially, the elements of the site, whether it is photos, logos, visuals, or texts.

 

  1. PERSONAL DATA 

SAS Victoria Valette is committed to preserving the confidentiality of the information provided by the buyer, which they may need to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978, and those of the European Regulation 2016/679, General Data Protection Regulation (GDPR).

As such, the user has the right to access, modify, and delete the information concerning them. They can request this at any time by mail at the following email address: info@victoriavalette.com.

 

  1. OUR RIGHT TO MODIFY THESE TERMS

We have the right to adjust and modify these Terms at any time.

You will be subject to the policies and Terms in effect at the time you use this website or at the time you place an order for products, unless we are required by law or a government authority to make retroactive changes to these policies, Terms, or Privacy Statement, in which case such changes will apply to orders previously placed by you.

 

  1. APPLICABLE LAW AND JURISDICTION

The use of our website and the agreements for the purchase of products through this site will be governed by French law.

Any dispute arising from or related to the use of the website or these agreements will be subject to the non-exclusive jurisdiction of the French courts. If you contract as a consumer, nothing in this clause will affect your statutory rights under the applicable law in force.
